You are using Passion Ride association’s online ticket selling service. The present Terms of Sale are systematically brought to the attention of each buyer to enable him/her to place an order. Consequently, the fact of placing an order implies the full and unreserved adhesion from the buyer to these Terms of Sale.
The Passion Ride association is the organiser of the Electric Games event which will take place from July 31st to August 2nd 2021 at La Teste De Buch.
1 – ACCESS TO THE PLACE
The event takes place in the town of La Teste-De-Buch on the areas validated with the municipality. Access to the venue is free, but participation in the events is prohibited to any person with proven violent, racist or insulting behaviour, as well as to any person who is proven to be drunk or under the influence of drugs, without prejudice to any prosecution.
It is recommended to be present at least 30 minutes before the start of the event. Participation to the events is not guaranteed after the start time of the event and does not entitle you to any reimbursement.
Access to the competitions will be refused to any competitor not wearing adequate protection, i.e. helmet, knee and elbow pads. An additional back protection is required to participate to the Electric Games E-Cups.
2 – PROHIBITED ITEMS
Items prohibited by the Internal Regulations of the event and location will be consigned or seized. The competitor undertakes to respect the law and regulations applicable to safety in sports venues, and in particular the provisions of articles L. 332-3 to L. 332-16 of the Sport Code.
3 – VIDEO SURVEILLANCE
The public is informed that, for their safety, the place may be equipped with a video surveillance system under the control of Police Officers and which may be used in the event of criminal proceedings. A right of access is provided for in accordance with article 10V of the law of 21 January 1995.
4 – IMAGE RIGHTS
Any person attending the event consents and grants the organiser the right to use and reproduce their image and voice,free of charge, on any medium related to the event and/or the promotion of the venue and the organiser’s activities, such as photographs, television and giant screen broadcasts, video or sound broadcasts and/or recordings, for 10 years and in Europe.
5 – PRICE AND NUMBER OF PLACES
Access to competitions and activities with EDPMs is permitted from the age of 12. Ticket prices are indicated in euros and include all taxes. Different types of prices can be offered depending on the event or the date of purchase.
The total number of seats booked per person is the responsibility of the organiser. All orders, whatever their origin, are only payable in Euros.
A ticket cannot be refunded even in the event of loss or theft, nor can it be taken back or exchanged, except in case of cancellation and on the organisers sole decision.
A ticket may also not be resold at a price higher than its face value. The organiser reserves the right to change prices at any time, but products will be invoiced on the basis of the price at the time of the order is made. The tickets remain the property of the event organiser until full payment to the Passion Ride association.
6 – ORDER TAKING
Orders are taken by the customer using the electronic order form available online on the event’s website. The sale is deemed to be formed as soon as the order form is received by the Passion Ride association. The customer undertakes, prior to any order, to complete the information requested through the form available online on the website. The customer certifies the truthfulness and accuracy of the information thus transmitted. The procedure for placing an order includes the following steps: research and choice of the event for which the client is placing the order; verification of the details of the order, its total price; correction of any errors; information on the client’s contact details and consultation and acceptance of the general terms and conditions of sale; verification of the information provided, payment of the order by the client. The customer’s order will be confirmed by e-mail.
In the case of an order for a competitor ticket, the e-ticket is materialised in the form of a QR code integrated into the invoice. This QR code must be presented at the event reception desk to collect the corresponding race number.
7 – CONSERVATION
In accordance with article L. 134-2 of the Consumer Code, the association Passion Ride ensures the conservation of the written record of the consumer’s order for a period of ten years from the delivery having been the subject of the order and guarantees him access to it at any time during this same period.
8 – METHOD OF PAYMENT
Payment by credit card or Paypal is available. These methods of payment allow you to book your tickets online and immediately in a firm way. The cards accepted for the payment of an order are ” Carte Bleue “, ” Visa ” and ” Mastercard “. For any payment, the buyer can be debited as soon as the final validation of the order. The debit of the chosen means of payment is independent of the actual withdrawal of the tickets. In any event, tickets are paid for even if you fail to collect your tickets.
9 – SECURITY OF PAYMENTS AND PERSONAL DATA
The Passion Ride association has entrusted its payment system to Stripe, a service provider specialising in secure online payments. We guarantee the total confidentiality of your banking information, secured by the SSL protocol, which systematically checks the validity of access rights when you pay by credit card and encrypts all exchanges in order to guarantee confidentiality. The personal data that you provide enables us to carry out your transaction. Furthermore, this data, once recorded, enables you to carry out your future transactions more quickly following the creation of your account. It also enables us to contact you, as far as possible, in the event of cancellation or modification of the date, time or place of a competition for which you have reserved entries.
The Passion Ride association may be led to ask you by email or telephone for additional information on the identity of the buyer (identity card) and the identity of the holder of the bank card used for payment, depending on the amount of your order and the existence of the buyer’s address.
You have at any time the right to access and rectify data concerning you by e-mail to the organiser’s address: contact[at]electric-games.org (art. 34 of the “Informatique et Liberté” law of 6 January 1978).
The information requested from the customer is necessary to process his order. Without this information, the association will not be able to register an order. The client is informed that all personal data collected will be subject to automated processing, the person responsible for processing being the organiser from whom the client places the order. The customer may write to the organiser with whom he places an order, whose contact details are indicated on the organiser’s website under the contact section, to exercise his rights of access, questioning, opposition on legitimate grounds and rectification with regard to information concerning him and which is processed by the organiser concerned, under the conditions provided for by the law of 6 January 1978. The customer has the right to object, free of charge, to the use of data concerning him/her for canvassing purposes, in particular for commercial purposes.
Cookies record certain information that is stored in the memory of the consumer’s disk. Under no circumstances do cookies contain confidential information, such as name or credit card number, but make it possible to remember the items selected during previous visits.
10 – VALIDATION
When you click on the “Pay my order” button at the end of the ordering process, you declare that you accept, by ticking the box “I have read and accept the General Terms and Conditions of Sale”, the General Terms and Conditions of Sale in full and without reservation. The data recorded by the Passion Ride association is proof of all transactions made by the Passion Ride association and its customers.
11 – OBTAINING COMPETITOR TICKETS
Competitor tickets are dematerialised, i.e. they take the form of a QR code displayed on the invoice received by email. This QR code must be presented to the competitor reception desk to collect the number corresponding to the e-ticket.
12 – E-TICKET SPECIFIC CONDITIONS
The buyer remains responsible for the use made of his e-tickets. The e-ticket is neither exchangeable nor refundable. It is personal and non-transferable.
This e-ticket is only valid for the specified place, event, date and time. In other cases, this e-ticket will not be valid.
The bearer must keep the e-ticket for the entire duration of his presence at the event venue.
13 – E-TICKET BENEFICIARIES
For all events, the purchaser must provide the surname, first names and date of birth of each beneficiary.
14 – CANCELLATION – POSTPONEMENT – INTERRUPTION – MODIFICATION OF THE PROGRAMME – REIMBURSEMENT
The competition ticket cannot be refunded, taken back or exchanged except in cases of force majeure. A ticket may also not be resold at a price higher than its face value.
In the event of cancellation of the event for reasons related to the COVID-19 pandemic, or in the event that the competitor is unable to attend the event due to restrictions related to the COVID-19 pandemic, your ticket(s) and options will be fully refunded.
In case of partial cancellation or interruption of the event, this ticket will not be refunded.
In the event of absence from the start line, delay and exclusion of the participant from the event, as well as in the event of violation of the provisions of these regulations, the fees will not be refunded.
The organiser may have to modify the programmes, the distribution, the timetables. These modifications do not lead to any exchange or refund. This ticket may not be taken back, exchanged or resold (Law of 27 June 1919).
15 – RIGHT OF WITHDRAWAL
In accordance with the provisions of Article L. 121-20-4 of the French Consumer Code, tickets ordered and whose price has been collected are not subject to a right of withdrawal.
16 – AGREEMENT OF PROOF
The computerised records kept in the computer systems of the Passion Ride association will be kept in reasonable conditions of security and will be considered as proof of communications, orders and payments that have taken place.
17 – APPLICABLE LAW – DISPUTES
The ticket sales referred to herein are subject to French law. In the event of a dispute, the French courts have sole jurisdiction.
